13 Under MiFID II, more investment products will be classified as ‘com- plex’. Those products are subject to stricter rules . Before offering them to you, your financial institution must check whether you possess an appropriate level of knowledge and experience. As a consequence, it will no longer be possible to give your financial institution a mandate to buy you a complex product. Yes, we do. In 2011, almost all financial institutions in Belgium signed on to the so-called Moratorium on the distribution of particularly complex financial products. The Financial Services and Markets Au- thority (FSMA) used the Moratorium to call upon the financial sector not to distribute to individual investors products that are considered particularly complex. MiFID II does not replace the Moratorium , which will remain in place for particularly complex products. However, MiFID II imposes strict- er rules for less complex products that fall outside the Moratorium’s scope yet are not suitable for every investor. What changes will MiFID II bring to complex products? But don’t we already have a Moratorium on complex products in Belgium?
